FTC Privacy Notices

The FTC has apparently indicated that provisions of the Gramm-Leach-Bliley Act (GLB) will apply to lawyers and law firms who are "significantly engaged" in "financial activities." The following links provide more details regarding the possible application of the law.

A course by the Tax Section of the ABA on June 19, 2001, described at http://www.abanet.org/cle/programs/t01ftc1.html, included the following materials which are available online in Microsoft Word format (if you don't have Word, you will need a plug-in to view these items):

  • Lawyers and Privacy Under the Gramm-Leach-Bliley Act: To Whom Does It Apply? By Charles Horn, Mayer Brown and Platt http://www.abanet.org/cle/programs/materials/t01ftc1cm1.doc.
  • Philadelphia Bar Memo: Model Notice http://www.abanet.org/cle/programs/materials/t01ftc1cm3.doc
  • The FTC has devoted a section of its website to the GLB. This website includes the actual language of both the act and implementing regulations. http://www.ftc.gov/privacy/glbact/index.html

In June, 2001 the ABA Board of Governors passed a resolution urging the FTC to exempt lawyer and law firms from the requirements of GLB. The resolution is contained in the summary of the June meeting available at http://www.abanet.org/leadership/June2001SummaryofAction.pdf. You will need Adobe Acrobat to read the file.
